TERMS OF SERVICE
1. Introduction and Acceptance
Hourcrate is a web-based service available at https://hourcrate.com. By creating an account, accessing the Service, or paying fees, you agree to these Terms on behalf of yourself or the organization you represent and confirm you are legally permitted to do so. If you do not agree, do not use the Service. We may update these Terms by posting a revised version, and your continued use after the effective date constitutes acceptance.
Hourcrate is operated by Mohammad Sayeem Khan, founder of Daywin Labs, based in Bangladesh.
2. Description of the Service
The Service helps teams set monthly hour limits, log work, and monitor retainers. We provide dashboards and exports to support your internal workflows. Hourcrate does not provide professional advice, and the accuracy of any time or client data you enter is your responsibility.
3. Account Registration and User Responsibilities
- Provide accurate account and billing information and keep it current.
- Maintain the confidentiality of your login credentials and notify us of any suspected misuse.
- Ensure you have the right to submit all data to the Service and that it complies with applicable laws and your client commitments.
- Do not misuse the Service, interfere with its operation, or attempt unauthorized access.
4. Subscription, Billing, and Payment Terms
- Paid plans are billed in advance on a recurring basis (for example, monthly or annually) until canceled.
- You authorize Hourcrate and our payment processors (including Stripe, Paddle, and 2Checkout) to store and charge your payment method for all fees, applicable taxes, and currency conversion costs. Their terms and privacy notices apply to your transactions.
- Prices exclude taxes unless stated otherwise; you are responsible for all taxes, duties, and bank or exchange fees.
- Failed, reversed, or disputed payments may result in suspension or termination of access.
- We may change plan features or fees; any price change will apply from your next renewal after notice. Continued use after the change means you accept the new fees.
5. Cancellation and Termination
You can cancel at any time in your account settings or by contacting support. Cancellation takes effect at the end of the current billing term, and access continues until then unless we suspend or terminate earlier for breach, risk, or non-payment. We may close inactive or free accounts after notice. After termination, your data may be deleted; export anything you need beforehand.
6. Refund Policy
Fees are non-refundable and non-creditable except where required by law. Canceling does not provide refunds for the current billing period. If you believe a charge was made in error or duplicated, contact support promptly and we will review the request.
7. Service Availability and Modifications
The Service may change over time, and features may be added, modified, or removed. We may suspend or limit the Service for maintenance, security, or operational reasons. We do not guarantee uninterrupted availability or data preservation; you are responsible for keeping backups or exports.
8. Limitation of Liability
To the fullest extent permitted by law, Hourcrate and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability for any claim relating to the Service is limited to the fees you paid for the Service in the three months before the event giving rise to the claim. These limits apply even if we have been advised of the possibility of such damages and regardless of the theory of liability.
9. Disclaimer of Warranties
The Service is provided on an "as-is" and "as-available" basis. Hourcrate disclaims all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. Your use of the Service is at your own risk.
10. Indemnification
You agree to indemnify and hold harmless Hourcrate, its affiliates, and their directors, officers, employees, and agents from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Service, your data, or any breach of these Terms or applicable law.
11. Governing Law and Jurisdiction
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules. The courts of Dhaka, Bangladesh will have exclusive jurisdiction over disputes relating to the Service, except where applicable law requires a different venue.
